Terms of Service
These terms govern your use of storyallergymarketing.com and the marketing services provided by Story LLC. Please read them carefully.

These Terms of Service (the “Terms”) are a binding agreement between you and Story LLC, a South Carolina limited liability company doing business as Story Allergy Marketing, a Story Agency brand (“Story,” “we,” “us,” or “our”). They apply to your access to and use of the website located at storyallergymarketing.com (the “Site”), the tools and features made available through it, and the marketing services we provide (collectively, the “Services”).
1. Acceptance of these terms
By accessing or using the Site or Services, by creating an account, or by entering into a separate written services agreement or statement of work with us, you agree to be bound by these Terms and by any policies referenced herein, including our Privacy Policy. If you do not agree to these Terms, do not access or use the Site or Services. If you are accepting these Terms on behalf of a practice, company, or other entity, you represent that you have the authority to bind that entity, and “you” refers to that entity.
Where you have signed a separate master services agreement, engagement letter, or statement of work with us (a “Services Agreement”), that Services Agreement governs the specific marketing services it describes. In the event of a conflict between these Terms and a signed Services Agreement, the Services Agreement controls with respect to its subject matter.
2. Description of services
Story is a patient-acquisition marketing agency serving allergy & immunology practices. Our Services may include, without limitation, search engine optimization, paid search and programmatic advertising, website design and development, content and creative production, reputation and reviews management, analytics and conversion tracking, and campaigns timed to seasonal and environmental demand signals.
The Site also provides informational content and tools, which may include pollen and weather data, growth resources, and a client portal. The Site and its tools are made available for general informational and business purposes. We may add, modify, suspend, or discontinue any part of the Site or Services at any time without liability, subject to the terms of any applicable Services Agreement.
3. Eligibility
You must be at least 18 years old and capable of forming a binding contract to use the Services. The Services are intended for business use by healthcare practices and their authorized representatives, not for personal, household, or consumer use. By using the Services, you represent that you meet these requirements and that the information you provide to us is accurate and complete.
4. Accounts and onboarding
Certain features, including the client portal, require an account. When you create an account or onboard with us, you agree to provide accurate, current, and complete information and to keep it updated. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us promptly at hello@storyllc.com if you suspect any unauthorized use.
During onboarding you may grant us access to advertising, analytics, website, social, listing, or review platforms, and you may provide assets, credentials, and account access necessary to deliver the Services. You represent that you have the right to grant such access and that doing so does not violate any third party’s terms or your obligations to any third party. You remain responsible for maintaining the confidentiality of any credentials you share and for the content and accounts you authorize us to manage.
5. Acceptable use
You agree not to, and not to permit any third party to:
- use the Site or Services for any unlawful, fraudulent, or deceptive purpose, or in violation of these Terms or any applicable law or regulation;
- upload, submit, or transmit any content that is unlawful, infringing, defamatory, or that you do not have the right to provide;
- provide us with protected health information or other sensitive personal data except as expressly contemplated by a signed Services Agreement and any applicable business associate agreement;
- interfere with, disrupt, probe, or attempt to gain unauthorized access to the Site, Services, accounts, systems, or networks;
- introduce malware or any code or routine intended to damage, disable, or impair the Site or Services;
- scrape, harvest, reverse engineer, or copy the Site, its tools, or its content except as permitted by law; or
- use the Services to send unsolicited communications or otherwise violate any anti-spam, advertising, or platform policies.
We may investigate suspected violations and may suspend or terminate access to protect the Site, the Services, or other users.
6. Intellectual property
The Site and Services, including all software, text, graphics, logos, designs, methodologies, and other content provided by us (excluding your materials and third-party materials), are owned by or licensed to Story and are protected by intellectual property and other laws. Except as expressly permitted by these Terms or a Services Agreement, you may not copy, modify, distribute, sell, or create derivative works from any part of the Site or Services. “Story,” “Story Allergy Marketing,” and related names and logos are marks of Story LLC.
You retain ownership of the materials, brand assets, and data you provide to us (“Your Materials”). You grant us a non-exclusive, worldwide license to use, host, reproduce, and adapt Your Materials solely to provide the Services. Ownership of deliverables we create for you, and any license terms applicable to them, are governed by your Services Agreement; absent such terms, deliverables are licensed to you upon full payment for your internal business use. We retain ownership of our pre-existing and general know-how, tools, templates, and methodologies. You agree that we may reference our work for you and use aggregated, de-identified performance data to improve and promote our Services.
7. Third-party services and data
The Site and Services rely on and link to third-party platforms and data sources, including advertising networks, analytics providers, hosting and content delivery services, and weather and pollen data providers. Your use of those services may be subject to their own terms and policies, and we are not responsible for their availability, accuracy, or practices.
Any weather, pollen, allergen, or related environmental information made available through the Site is provided for general informational and marketing purposes only. It is not medical advice, is not a substitute for professional medical judgment, diagnosis, or treatment, and may be inaccurate, delayed, or incomplete. It should not be relied upon for any clinical, health, or safety decision. Always seek the advice of a qualified healthcare provider with any questions regarding a medical condition.
8. Disclaimers
The Site and Services are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranties arising from course of dealing or usage of trade.
We do not warrant that the Site or Services will be uninterrupted, secure, or error-free, that defects will be corrected, or that any content or data, including third- party data, is accurate or reliable. Marketing involves many factors outside our control, and we do not guarantee any specific result, ranking, lead volume, patient acquisition, revenue, or return on investment. Any examples or projections are illustrative and not promises of performance.
9. Limitation of liability
To the fullest extent permitted by law, in no event will Story or its members, managers, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or relating to these Terms, the Site, or the Services, whether based in contract, tort, strict liability, or otherwise, even if advised of the possibility of such damages.
To the fullest extent permitted by law, our total aggregate liability arising out of or relating to these Terms, the Site, and the Services will not exceed the greater of (a) the total amounts you paid to us for the Services giving rise to the claim during the three (3) months immediately preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (US$100). These limitations apply notwithstanding the failure of any essential purpose of any limited remedy. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
10. Indemnification
You agree to defend, indemnify, and hold harmless Story and its members, managers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to: (a) your use of the Site or Services; (b) Your Materials or content you provide or authorize us to publish; (c) your violation of these Terms or any applicable law; or (d) your violation of any rights of a third party, including any patient privacy, advertising, or platform requirement. We will provide reasonable notice of any such claim and may participate in the defense with counsel of our choosing.
11. Governing law and dispute resolution
These Terms and any dispute arising out of or relating to them, the Site, or the Services are governed by the laws of the State of South Carolina, without regard to its conflict-of-laws principles. You agree that the exclusive venue for any dispute not subject to a binding dispute-resolution provision in a Services Agreement will be the state or federal courts located in Greenville County, South Carolina, and you consent to the personal jurisdiction of those courts. Any claim must be brought in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
12. Changes to these terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, where appropriate, provide additional notice. Changes are effective when posted. Your continued use of the Site or Services after the changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Site and Services.
13. Termination
You may stop using the Site and Services at any time. We may suspend or terminate your access to the Site, your account, or the Services at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law, or to protect the Site, the Services, or others. Termination of any marketing engagement is governed by your Services Agreement. Upon termination, the rights and licenses granted to you will end, and the sections of these Terms that by their nature should survive—including intellectual property, disclaimers, limitation of liability, indemnification, and governing law—will survive.
